PCB Standard of Care

Gradient examined the causation; timing; and historical standards of care related to polychlorinated biphenyl (PCB) contamination at a chemical manufacturing plant which resulted from historical leaks/spills from electrical transformers and other industrial equipment. The facility produced chemical intermediates used in formulations for fragrances and cosmetics. Gradient considered both historical regulations and insurance policy coverage periods to identify historical uses of PCBs and the environmental distribution of multiple Aroclors found at the plant site. We provided opinions on probable causes and whether the manufacturer exercised reasonable standards of care based on historical regulations and industrial practices as input in the settlement of an insurance cla
